SURGICAL ERRORS

Donnacha Anhold, Principal of Carter Anhold Solicitors & Co, gives advice on Medical Negligence.

If you have been a patient of a surgical procedure, you should be aware that the majority of operations are performed to the proper standard and, if performed by a competent surgeon, are normally performed correctly and without complications.

However, medical mishaps or medical mistakes can occur, and regularly patients suffer injury or harm due to surgical problems, mishaps, or mistakes.

Depending on the type of injury or damage, the harm can be capable of being recovered from, but in other medical operations the negligent manner in which the operation was performed can result in permanent injury or disability or even fatality.

All medical or surgical operations do involve a certain level of risk.

All of these risks should be outlined to you by your Doctor prior to agreeing to undergo the procedure, and if you then consent to having the procedure performed on you, that means you are providing “informed consent”.

Failure to allow you the option of providing informed consent to a procedure can result in negligence itself.

Types of Surgical Error include

  • accidental perforation of organs
  • incorrect procedures carried out
  • operations performed on the wrong body part or organ
  • foreign bodies such surgical equipment  or other implements left inside the patient after the operation
  • surgical injuries to nerves, tissues and blood vessels
  • damage to vile ducts during gall bladder removal
  • laser eye surgery complications
  • difficulties arising from hysterectomies
  • Non availability or other issues with informed consent

This is not an exhaustive list, and if you have a specific query about any type of medical or surgical procedure, please feel free to call Carter Anhold Medical Misadventure Solicitors Sligo on 071 916 2211 or make an enquiry

The time limits in medical negligence claims can be extremely prohibitive, and your legal claim must be commenced within two years from when the incident occurred or when you first became aware or had knowledge, that you have suffered an injury. It is very advisable to get the advice that you need as soon as you become aware of a medical difficulty or injury as a result of medical or surgical treatment or a medical or surgical procedure.

A WORD FROM OUR CLIENTS …

I highly recommend Donnacha and Carter Anhold. They are a hard working, patient and professional team as well as being experts in Family Law.  After a negative experience before Carter Anhold, I decided that hiring a private solicitor was in my best interests.
I am happy to say that my separation case was settled in my favour in a timely and stress-free manner. I would not hesitate to recommend Donnacha to others that are dealing with the sensitive issues around Family Law.
